General Terms and Conditions of Sale

Last updated: 21 October 2026

This is a translation provided for convenience. In case of any discrepancy, the French version prevails.

The company EmiRise (« EmiRise » or « We »), a Société par Actions Simplifiée (simplified joint-stock company) with a share capital of 1,000 euros, registered with the Aix-en-Provence Trade and Companies Register (RCS) under number 927 450 569, whose registered office is at 4 Rue Paul Marie Couton, Lotissement L'Esquirou, 13790 Rousset, carries on a concierge business: it provides services (guest welcome, key handover, cleaning, linen, assistance during the stay, additional services) for properties located in and around Aix-en-Provence.

EmiRise is neither an estate agent, nor a property manager (administrateur de biens), nor an agent acting on behalf of the owners of the properties (the « Owners »). It is not authorised to enter into a rental agreement on behalf of an Owner and does not receive, hold or manage any sum paid in respect of the rental (price of the stay, security deposit). The rental agreement is entered into directly between the guest (the « Client » or « You ») and the Lessor defined in Article 1, to whom the Client pays the price of the stay.

These General Terms and Conditions of Sale (the « GTCS », in French « CGV ») apply to any booking request made by a natural person of full age (at least 18 years old) acting in a private capacity, on the website www.emirise.fr (the « Site »), for one or more properties presented on the Site (the « Property » or « Properties »).

By submitting a booking request, the Client acknowledges having read the GTCS and accepts them without reservation.

The services offered are reserved exclusively for natural persons of full age. Any person under 18 years of age is prohibited from submitting a booking request. Any booking made by a minor may be cancelled, without notice or compensation.

Article 1 — Definitions

The following terms, whether used in the singular or the plural, are defined as follows:

  • — « Client »: any natural person of full age (18 years or over) making a booking request for personal and non-commercial use.
  • — « GTCS »: these General Terms and Conditions of Sale.
  • — « Booking Request »: the request sent by the Client via the form on the Site with a view to booking a Property for a specified period. The Booking Request does not constitute a firm booking until it has been accepted by the Lessor and confirmed.
  • — « Booking »: the Booking Request accepted by the Lessor and confirmed by payment in full of the stay to the Lessor.
  • — « Property »: any real property offered for seasonal rental on the Site.
  • — « Owner »: the natural or legal person who owns the Property and entrusts EmiRise with concierge services.
  • — « Lessor »: the person who lets the Property to the Client and with whom the rental agreement is entered into. This is the Owner or, where EmiRise itself holds a lease authorising it to offer the Property for rent, EmiRise. The identity of the Lessor is stated in the Booking summary.
  • — « Site »: the website www.emirise.fr.
  • — « Rate »: the total price of the stay, expressed in euros including all taxes (TTC), comprising the rental of the Property and the included services.
  • — « House Rules »: the document given to the Client before arrival, setting out the rules for the use of the Property.

Article 2 — Purpose

The purpose of these GTCS is to set out the conditions under which the Client submits a Booking Request for a Property presented on the Site, the conditions of the seasonal rental entered into with the Lessor, and the conditions of the concierge services provided by EmiRise.

The GTCS apply to any individual Booking Request for a maximum duration of one (1) month. For any booking of a longer duration, or for any simultaneous booking of more than two (2) Properties, the Client is invited to contact EmiRise directly at contact@emirise.fr to discuss the applicable conditions.

Article 3 — Booking process

3.1 Booking Request

The Client submits a Booking Request via the form available on the Site, providing:

  • — Their contact details (surname, first name, email, telephone)
  • — The requested arrival and departure dates
  • — The number of guests
  • — The chosen Property
  • — Any message or special request

The Booking Request does not constitute a firm booking and creates no obligation on the part of EmiRise or the Lessor until it has been expressly accepted by the Lessor.

3.2 Review and acceptance of the Request

The Booking Request is passed on to the Lessor, who alone is authorised to accept or refuse it, freely and without having to give reasons for its decision, in particular where the Property is unavailable, where there is doubt as to the reliability of the information provided, or for any other legitimate reason. The response is communicated to the Client within an indicative period of 48 working hours.

3.3 Confirmation and payment

If the request is accepted, the Client receives a detailed Booking summary stating the identity of the Lessor, the total Rate, the arrival conditions and the terms of payment of the stay to the Lessor.

The Client has 48 hours from receipt of this summary to make payment in full for the stay (100% of the Rate). If payment is not made within this period, the Booking Request shall be deemed to have lapsed and the Property may be offered to another Client.

The Booking is definitively confirmed upon receipt of payment in full by the Lessor. The Client then receives a confirmation email.

3.4 No right of withdrawal

In accordance with Article L.221-28 12° of the French Consumer Code (Code de la consommation), accommodation services provided on a specific date or with a specific periodicity are not subject to the right of withdrawal.

By accepting these GTCS and confirming payment, the Client expressly waives any possibility of withdrawal and acknowledges that the Booking constitutes a firm and binding contract, subject only to the cancellation conditions set out in Article 7.

3.5 Identity verification

The Client may be asked, at any time before arrival, for a copy of their identity document in order to verify that they are of full age and that the information provided is accurate. In the event of refusal or of incorrect information, the Lessor may cancel the Booking without refund.

Clients of foreign nationality may be required to complete an individual police registration form in accordance with the provisions of the French Code on the Entry and Residence of Foreign Nationals (Code de l'entrée et du séjour des étrangers, CESEDA).

Article 4 — Rates and included services

4.1 Rate

The Rate displayed on the Site is expressed per night and in euros including all taxes (TTC). It varies according to the Property, the period, the length of the stay and the number of guests.

The Rate, paid to the Lessor, includes:

  • — The rental of the Property for the duration of the stay
  • — Utilities (water, electricity, heating, air conditioning where applicable)
  • — Household linen (sheets, towels)
  • — WiFi
  • — End-of-stay cleaning
  • — Welcome and assistance by the EmiRise team

Unless expressly stated otherwise, the Rate does not include:

  • — The tourist tax (taxe de séjour)
  • — Additional services (private chef, transfers, experiences, etc.)
  • — The security deposit

4.2 Tourist tax

The tourist tax, set by the local authorities, is payable in addition to the Rate. Its amount is specified at the time of the Booking Request and is collected separately, in accordance with the rules applicable to the Property.

4.3 Occupancy capacity

The maximum number of guests permitted per Property is strictly defined on the Property's listing and may not be exceeded under any circumstances. Any excess observed on arrival may result in access to the Property being refused, without refund.

Children over two (2) years of age count as full occupants. A baby cot may be provided free of charge on prior request and subject to availability.

4.4 Additional services

At the Client's request and subject to availability, EmiRise may offer additional services (private chef, transfers, pre-arrival grocery shopping, etc.). These services are invoiced separately. Where they are performed by third-party service providers, EmiRise merely recommends them and helps to organise them, and cannot be held liable for the quality or conformity of the services performed by those providers.

Article 5 — Payment

5.1 Terms

Payment for the stay is due in full (100%) at the time the Booking is confirmed. It is made to the Lessor. Payment is made online by bank card (Visa, Mastercard, American Express) via a secure payment provider, or by bank transfer with prior authorisation.

Where the Lessor is the Owner, the sums paid by the Client for the stay are collected directly by the Owner. EmiRise does not receive, hold or pass on any sum on behalf of the Owners: it is remunerated by them solely for its own services, which it invoices to them directly.

Proof of payment for the stay is issued by the Lessor. Additional services provided by EmiRise are invoiced by EmiRise.

5.2 Fraudulent payment

Any Booking may be cancelled in the event of fraudulent, unlawful, incomplete or suspicious payment, without any compensation being due to the Client.

Article 6 — Security deposit

6.1 Amount and terms

A security deposit, the amount of which varies according to the Property (typically from €1,500 to €5,000), is required before arrival. It takes the form of a bank card hold (pre-authorisation) or a bank transfer, at the Client's choice.

The exact amount is specified in the Booking summary. The security deposit is provided for the benefit of the Lessor: EmiRise neither collects nor holds it.

6.2 Return

If no damage is found, the security deposit is released by the Lessor within a maximum of seven (7) days following the Client's departure. Bank processing times may add a few additional days.

6.3 Deductions

The security deposit may be withheld in part or in full in the event of:

  • — Physical damage to the Property, its furniture or its equipment
  • — Missing or damaged items
  • — Excessive end-of-stay cleaning (abnormal condition of the Property)
  • — Exceeding the number of occupants
  • — Proven nuisance (smoking, noise, complaints from neighbours)
  • — Unpaid services consumed

If the amount of the deposit proves insufficient to cover the losses, the Lessor reserves the right to claim the balance by any legal means.

Article 7 — Cancellation and amendment

7.1 Cancellation by the Client

Any cancellation request must be sent by email to contact@emirise.fr.

The following cancellation conditions apply:

  • — Cancellation more than fourteen (14) days before the arrival date: full refund of the Rate, less a flat administration fee of €50
  • — Cancellation fourteen (14) days or less before the arrival date: no refund; the Rate remains payable in full

Any refunds of the stay are made by the Lessor, who received the corresponding sums. Additional services booked (chef, transfers, etc.) are not refundable beyond the deadlines specific to each service provider.

EmiRise strongly recommends that the Client take out cancellation insurance with an insurer of their choice.

7.2 Amendment by the Client

Any amendment request (dates, length of stay, Property, number of guests) must be sent by email to contact@emirise.fr. The request is passed on to the Lessor, who considers it subject to availability and without any obligation to accept it. Any accepted amendment may lead to a revision of the Rate.

An amendment not accepted by the Lessor will be treated as a cancellation under the conditions of Article 7.1.

7.3 Cancellation by the Lessor

The Lessor reserves the right to cancel a Booking in the event of:

  • — Force majeure (as defined in Article 12)
  • — Unforeseen unavailability of the Property (damage, major technical failure)
  • — Fraudulent or inappropriate behaviour by the Client
  • — Failure to comply with these GTCS

In the event of cancellation due to force majeure or unavailability, EmiRise will endeavour to help the Client find a Property of an equivalent category for the same period. Failing this, all sums paid will be refunded to the Client by the Lessor within fourteen (14) days, without any further compensation.

7.4 No-show

If the Client fails to arrive on the scheduled arrival date without prior cancellation, no refund will be made.

Article 8 — Arrival and departure

8.1 Times

Unless otherwise agreed:

  • — Arrival (check-in): from 4.00 pm (16:00)
  • — Departure (check-out): by 10.00 am (10:00) at the latest

8.2 Arrangements

No later than 24 hours before arrival, the Client will receive by email the exact address of the Property, the access arrangements and the contact details of the EmiRise team.

Check-in takes place either in the presence of a member of the EmiRise team for a personal welcome, or independently using an access code, depending on the Property and the arrival time.

8.3 Early arrival / Late departure

Subject to availability and prior agreement, an early arrival or late departure may be offered, possibly for an additional charge. Failing agreement, any departure after 10.00 am may result in an additional night being charged at the current rate.

8.4 Inventory and condition report

An inventory and condition report (état des lieux) is carried out on arrival (in person or via a digital inventory) and on departure. The Client is asked to report immediately to EmiRise any damage or malfunction found on arrival, failing which they may be held responsible for it.

Article 9 — House Rules and obligations of the Client

The Client undertakes to comply with the House Rules of the Property, which will be sent to them before arrival, as well as with the following obligations:

9.1 Use of the Property

  • — The Property is intended for personal residential use and exclusively for the purpose of a tourist stay.
  • — It is strictly prohibited to hold parties, events, film or photo shoots or commercial activities there without the prior written consent of EmiRise.
  • — Subletting, lending or assigning the Property to third parties is strictly prohibited.
  • — Under no circumstances may the Client make the Property their main residence or establish their domicile there, whether for tax or any other purposes.

9.2 Respect for neighbours

  • — The Client undertakes to respect the peace and quiet of the other occupants of the building and of the neighbourhood.
  • — Noise disturbance after 10.00 pm (22:00) is strictly prohibited.
  • — In the event of repeated complaints, the Lessor reserves the right to terminate the stay without refund.

9.3 Smoking and substances

  • — Smoking inside the Property is strictly prohibited. Any breach will result in a charge for deep cleaning (from €250).
  • — The use of any illegal substance is strictly prohibited.

9.4 Pets

  • — Unless otherwise stated in the description of the Property, pets are not allowed.
  • — Where they are allowed, the Client must inform EmiRise at the time of the Booking Request. A supplement may be charged.

9.5 Safety and equipment

  • — The Client undertakes to use the equipment of the Property with care and in accordance with its intended purpose.
  • — The Client must close the windows and doors when absent.
  • — The Client must report any incident, damage or malfunction to EmiRise without delay.

9.6 Maximum capacity

  • — The number of occupants may not exceed the maximum capacity of the Property stated on its listing.
  • — Any undeclared additional occupant will result in a supplement being charged and may justify the immediate termination of the Booking.

In the event of a serious or repeated breach of these obligations, the Lessor reserves the right, at any time and without notice, to terminate the Booking, to ask the Client to leave the Property and to retain all sums paid, without prejudice to any claim for damages.

Article 10 — Liability of the Client

The Client is liable for any material or non-material damage caused to the Property, to its equipment, to its occupants or to third parties, by the Client, by the other occupants or by any person the Client has invited into the Property.

The Client is required to take out holiday insurance (assurance villégiature) covering their civil liability for the duration of the stay. The Client may be asked to provide a certificate of insurance before arrival.

EmiRise and the Lessor accept no liability for the theft, loss or damage of the Client's personal belongings in the Property or in the common areas.

Article 11 — Liability of EmiRise

11.1 Nature of the undertaking

In performing its services, EmiRise is bound by an obligation of means (obligation de moyens) and not an obligation of result (obligation de résultat).

Where the Lessor is the Owner, EmiRise is not a party to the rental agreement. It cannot be held liable for failures attributable to the Owner (condition of the Property, missing or defective equipment, etc.) beyond the services that it provides.

11.2 Conformity of the Property

The descriptions, photographs and illustrations presented on the Site are indicative and not contractually binding. Minor variations may occur (furniture, decoration). The Client shall not be entitled to any compensation in this respect.

11.3 Limitations

EmiRise cannot be held liable for:

  • — Temporary interruptions of services (water, electricity, internet) attributable to suppliers or to the authorities
  • — Disturbances originating outside the Property (works in the building, neighbours, etc.)
  • — Any indirect damage (loss of enjoyment, loss of earnings, etc.)
  • — Services performed by third-party service providers (drivers, chefs, etc.)

In the event of a proven failure, the liability of EmiRise is limited to the amount of the sums it has actually received for its own services in respect of the Booking concerned.

11.4 Insurance

EmiRise holds Professional Liability insurance (Responsabilité Civile Professionnelle) « Prestataire de Service » (service provider) taken out with AXA France IARD SA (Société anonyme with a share capital of €214,799,030, registered office: 313 Terrasses de l'Arche, 92727 Nanterre Cedex, RCS Nanterre 722 057 460), under policy number 11250464004.

This insurance covers the activity of EmiRise for damage occurring in France, within the limits and conditions set by the insurance policy.

Article 12 — Force majeure

Neither Party may be held liable for a failure to perform its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code (Code civil), such as, in particular and without limitation: natural disaster, fire, flood, epidemic or pandemic, war, terrorist attack, riot, general strike, or a decision of the public authorities preventing performance of the contract.

In the event of force majeure making it impossible to perform the Booking, a postponement of the stay will be offered as a priority. Failing agreement, the Rate will be refunded by the Lessor, less any costs already incurred.

Article 13 — Personal data

In connection with the Booking, EmiRise collects and processes the Client's personal data (identity, contact details, payment data, etc.) in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR — in French, RGPD) and the amended French Data Protection Act (loi Informatique et Libertés).

The Client has a right of access, rectification, erasure, portability, restriction and objection in respect of their data. These rights may be exercised by email to contact@emirise.fr.

The detailed terms of processing are set out in the Privacy Policy available on the Site.

Article 14 — Intellectual property

All content on the Site (texts, photographs, logos, graphics, etc.) is the exclusive property of EmiRise or its partners and is protected by intellectual property law.

Any unauthorised reproduction, representation, modification or exploitation is prohibited and may give rise to legal proceedings.

The Client may photograph the Property for their personal use but may not sell or publish these photographs without the prior written consent of EmiRise.

Article 15 — Complaints and mediation

15.1 Complaints

Any complaint must be sent to EmiRise within thirty (30) days following the end of the stay, by email to contact@emirise.fr or by registered letter with acknowledgement of receipt to the address of the registered office.

The complaint must state: the booking number, the dates of the stay, the Property concerned, the reason for the complaint and any relevant supporting documents.

EmiRise undertakes to respond within fifteen (15) working days.

15.2 Mediation

In accordance with Article L.612-1 of the French Consumer Code (Code de la consommation), if the complaint is unsuccessful, a Client who is a consumer may have recourse, free of charge, to a consumer mediator with a view to the amicable resolution of the dispute.

Article 16 — Governing law and jurisdiction

These GTCS are governed by French law.

In the event of a dispute, and after any attempt at amicable resolution and mediation has failed, the courts of Aix-en-Provence shall have exclusive jurisdiction, subject to mandatory consumer protection provisions.

Article 17 — Miscellaneous provisions

17.1 Amendment of the GTCS

EmiRise reserves the right to amend these GTCS at any time. The applicable GTCS are those in force on the date of the Booking Request.

17.2 Partial invalidity

If one or more provisions of the GTCS are declared null and void or unenforceable, the other provisions shall remain in full force and effect.

17.3 Entire agreement

These GTCS, together with the Booking confirmation, the House Rules of the Property and the Privacy Policy, constitute the entire agreement between the Client, the Lessor and EmiRise.

Article 18 — Acceptance

By submitting a Booking Request and ticking the box provided for this purpose on the Site, the Client acknowledges having read these GTCS and accepts them without reservation.
